Article 2 – Definitions

In these general terms and conditions, the following terms shall have the following meanings:

Trader:     Kix Distribution BV

Online shop:     the website www.kix.energy

Consumer:     the natural person who is not acting in the course of a trade, business, craft or profession

Agreement:     the distance contract between the trader and the consumer

Products:     food supplements and related products

Article 3 – Applicability

These general terms and conditions apply to every offer made by the trader and to every contract concluded via the webshop. Deviations are only valid if agreed in writing.

If any provision proves to be void or voidable, the remaining provisions shall remain in full force and effect.

Article 4 – The offer

All offers are subject to change and are valid whilst stocks last. Product descriptions are provided as accurately as possible. Obvious errors or omissions do not bind the trader. Images are for illustrative purposes only and may differ from the actual product.

Article 5 – Conclusion of the contract

The contract is concluded at the moment the consumer places an order and receives an order confirmation by email. The trader reserves the right to refuse orders or to request additional information.

Article 6 – Prices and payment 

All prices are quoted in euros, inclusive of VAT and exclusive of delivery costs, unless otherwise stated.

Payment must be made in full via the payment methods offered through the webshop before delivery takes place.

If the consumer fails to meet their payment obligation on time, the consumer is automatically in default, without the need for a further notice of default.

From the due date, the consumer shall owe statutory interest on the outstanding amount as referred to in Article 6:119 of the Civil Code.

If Kix Distribution BV is compelled to take debt collection measures, all reasonable extrajudicial collection costs shall be borne by the consumer.

These costs are calculated in accordance with the Decree on Compensation for Extrajudicial Collection Costs, with a minimum of €40.

The collection costs and interest owed by the consumer shall be added to the outstanding amount.

Article 7 – Delivery

Delivery shall take place at the address provided by the consumer within the Benelux.

Stated delivery times are indicative and not binding deadlines.

The risk of damage or loss passes to the consumer at the time of delivery.

Article 8 – Right of withdrawal

The consumer has the right to withdraw from the contract within 14 days of receipt without giving any reason.

During the cooling-off period, the consumer must handle the product with care.

Sealed food supplements are excluded from withdrawal if the seal has been broken after delivery, for reasons of health protection and hygiene (Article 6:230p of the Dutch Civil Code).

Article 9 – Exercising the right of withdrawal and returns

The consumer may use a withdrawal form available via the webshop.

Returns are at the consumer’s expense and risk, unless otherwise agreed.

Following a valid withdrawal, the purchase price will be refunded within 14 days.

Article 10 – Conformity and complaints

The trader guarantees that the products comply with the contract and legal requirements. Complaints may be submitted via info@kix.energy. Complaints will be substantively addressed within 14 days at the latest.

Article 11 – Intellectual property

All intellectual property rights relating to the webshop www.kix.energy, including but not limited to texts, images, logos, trademarks, product names, visualisations, designs, videos and software, are vested exclusively in Kix Distribution BV or its licensors.

The consumer is not permitted, without the prior written consent of Kix Distribution BV, to reproduce, publish, distribute, modify or otherwise use any material from the webshop, in whole or in part, other than for personal, non-commercial use.

The use of the trade name, trademarks, logos and other distinctive signs of Kix Distribution BV without permission is not permitted.

Should the consumer act in breach of this article, Kix Distribution BV reserves the right to take appropriate (legal) measures and to recover any damages.

Article 12 – Liability

The trader shall not be liable for indirect or consequential damage.

Liability is limited to a maximum of the amount of the order in question.

Information on the online shop is not a substitute for professional medical advice.

Article 13 – Use of food supplements

The consumer is personally responsible for the correct use of the products.

Consult a doctor or expert in the event of pregnancy, medication use or medical conditions.

Results from dietary supplements may vary from person to person.

Article 14 – Force majeure

The trader is not obliged to fulfil obligations in the event of force majeure.

Force majeure includes: disruptions with carriers, supplier issues, pandemics and government measures.

Article 15 – Privacy

Personal data is processed in accordance with the General Data Protection Regulation (GDPR).

The privacy policy can be viewed at www.kix.energy.

Article 16 – Applicable law and disputes

All agreements between Kix Distribution BV and the consumer are governed exclusively by Dutch law.

The applicability of the Vienna Sales Convention (United Nations Convention on Contracts for the International Sale of Goods – CISG) is expressly excluded.

Disputes arising from or in connection with the agreement shall be submitted to the competent court in the Netherlands.
